Terms of Service

Last updated: draft, not yet published.

Draft — not yet legally reviewed. This describes, in plain terms, how Headstrong is actually meant to be used. It has not been reviewed by a lawyer and must not be treated as a finished or binding agreement. Bracketed placeholders (e.g. [Legal entity name]) need to be filled in before this goes live.

Who this agreement is with

These terms are between you and [Legal entity name, ABN](“we”, “us”), the operator of Headstrong. By creating an account or using the platform, you agree to these terms. If you’re a parent or guardian giving consent for a minor, you’re agreeing to these terms on their behalf as well as your own.

Who Headstrong is for

Headstrong is a concussion education platform for community football clubs. It’s used by club administrators to assign and track education modules, and by players (including players under 18, with guardian consent) to complete those modules.

Accounts

Accounts are created by invitation from a club administrator. You’re responsible for keeping your login credentials secure and for activity that happens under your account. If a player is under 18, their account cannot be used to access modules or take quizzes until a parent or guardian has provided consent through the platform.

Educational content — what it is and isn't

The modules and quizzes on Headstrong are educational content: they help players and clubs recognise possible signs of concussion, understand general return-to-play protocols, and know what to do next. Headstrong does not diagnose concussion, assess the severity of an injury, or determine whether any individual is safe to return to play. A quiz score or a completed-module record reflects that someone engaged with the educational content — it is not a medical assessment, and it is not a substitute for evaluation by a qualified doctor or sports physician. Any decision about an actual suspected concussion should be made by, or in consultation with, a qualified health professional, not by anything shown in this app.

Compliance records

When a player completes a module, Headstrong creates a completion record that their club can see. This record is evidence that the player engaged with the required education content — it is a record of participation, not a medical or legal certification of anything beyond that. Clubs are responsible for how they use these records in their own risk-management or compliance processes.

Club subscriptions and billing

Clubs subscribe to Headstrong on a recurring basis at one of the published tiers. Payments are processed by Stripe. Subscriptions renew automatically until cancelled by a club administrator; access to paid features ends at the end of the then-current billing period after cancellation. [Refund policy to be confirmed.]

Acceptable use

Don’t use Headstrong to access or share content you’re not authorised to see, attempt to circumvent the quiz grading or access controls, or use the platform in a way that could harm other users, the club, or us.

Intellectual property

The module content, quizzes, and platform itself are owned by us or our licensors. Your club and its members have a licence to use them as part of an active subscription — this doesn’t give you the right to copy or redistribute the content outside the platform.

Termination

We may suspend or terminate an account that violates these terms. A club administrator can remove a player’s access at any time; that player’s existing completion records are retained for the club’s compliance purposes as described in our Privacy Policy.

Disclaimer and limitation of liability

Headstrong is provided “as is”. To the maximum extent permitted by law, we aren’t liable for any injury, loss, or damage arising from reliance on the educational content, or from a decision about return-to-play made without appropriate medical advice. [Standard liability-cap language to be added by counsel.]

Governing law

These terms are governed by the laws of [State/Territory, Australia].

Changes to these terms

We may update these terms as the product changes. We’ll update the “last updated” date above when we do.
